La Procura europea e l’effettività della cooperazione giudiziaria in materia penale: tutele disomogenee e reali progressi.
Il presente contributo è diretto ad esaminare le criticità messe in luce dall’entrata in funzione della Procura europea (EPPO), il 1° giugno 2021, per valutare come e in che misura il pubblico ministero europeo abbia contribuito a garantirel’effettività in un settore particolarmente sensibile, quale quello della cooperazione giudiziaria in materia penale.
Infatti, a due anni dalla sua operatività è possibile tracciare un primissimo bilancio riguardo ai risultati perseguiti sull’effettività di tale settore, ma soprattutto ai problemi sollevati dalla collaborazione tra le procure degli Stati membri e quella europea. Problemi che hanno trovato espressione in un primo rinvio pregiudiziale disposto dalla Corte di appello di Vienna e pendente presso la Corte di giustizia (C-281/22), concernente il regolamento 2017/1939, relativoall’attuazione di una cooperazione rafforzata sull’istituzione della Procura europea, su cui si è pronunciato già l’Avvocatogenerale il 22 giugno ed alla luce del quale è possibile misurare il grado di effettività raggiunto.
This contribution aims to examine the critical issues highlighted by the establishment of the European Public Prosecutor’s Office (EPPO) on June 1, 2021, in order to assess how and to what extent the European Public Prosecutor hascontributed to ensuring effectiveness in a particularly sensitive area, namely the judicial cooperation in criminal matters.
Indeed, two years after its operationalization, it is possible to draw a very preliminary assessment regarding the results achieved in terms of the effectiveness of this sector, but above all, the issues raised by the collaboration between theprosecutors of the Member States and the European Prosecutor’s Office. These issues are faced in a preliminary ruling made by the Vienna Court of Appeal and pending before the Court of Justice (C-281/22), concerning Regulation2017/1939, which relates to the establishment of the European Public Prosecutor’s Office, on which the Advocategeneral already delivered an opinion on June 22nd, and in light of which it is possible to measure the degree of effectiveness achieved.
