Abstract

Il presente contributo fornisce alcune osservazioni circa il possibile sviluppo della competenza dell’Unione europea nell’ambito dell’istruzione nel prossimo futuro. La prima parte si focalizza sullo stato dell’arte, ricordando le principali azioni realizzate dall’Unione in questo settore, nonché i caratteri di un diritto fondamentale dell’uomo all’istruzione in ambito europeo. Nella seconda parte vengono illustrate e discusse criticamente le proposte di modifica ai Trattati presentate dal Parlamento europeo a novembre 2023 relativamente alla competenza in materia di istruzione. Delineate alcune criticità di questa proposta, conclusivamente vengono presentati alcuni sviluppi possibili dell’integrazione fra Stati membri nell’istruzione, auspicabili anche a fonti primarie immutate.

Abstract (ENG)

The present paper submits some preliminary remarks on the potential future development of the EU competence in the field of education. The first part focuses on the existing state of the art, recalling the main actions realised by the European Union in this subject, and the characteristics of a fundamental human right to education at the European level. In the second part, the contribution describes the proposal to modify the Treaties presented by the European Parliament in November 2023 in the field of education. Some critical aspects of the proposal are outlined. Finally, the author presents some developments within the EU Member States integration in the educational field, which are possible within the current legal framework.
