UPC’s First Reference to the CJEU on Brussels I bis
Il contributo sintetizza il primo rinvio pregiudiziale (6 marzo 2026) della Corte d’appello del Tribunale Unificato dei Brevetti (TUB) alla CGUE, scaturito dalla causa Dyson c. Dreame ed Eurep per contraffazione brevettuale con richiesta di misure cautelari estese alla Spagna (Stato non-TUB). Il rinvio verte sull’interpretazione del Regolamento Bruxelles I bis: in particolare, se un intermediario stabilito nel territorio TUB possa fungere da convenuto “ancora” (Art. 8(1)) per radicare la giurisdizione su una società extra-UE, e l’effettiva estensione transfrontaliera delle misure provvisorie (Art. 71b(2)). L’analisi evidenzia il rischio che un’interpretazione troppo estensiva favorisca il forum shopping e introduca una controversa giurisdizione extraterritoriale.
