L’articolo illustra la reazione dell’Unione europea allo sviluppo dell’epidemia di Coronavirus. In particolare, l’analisi si concentra sull’attivazione degli strumenti previsti dallo European Disaster Law, ossia l’insieme delle norme sovranazionali concernenti la gestione di calamità. Al riguardo, particolare enfasi è data al Meccanismo UE di protezione civile e alla Decisione n. 1082/2013/UE relativa alle gravi minacce per la salute a carattere transfrontaliero ed alle implicazioni giuridiche che derivano dalla loro attuazione. Un altro profilo analizzato nel contributo è relativo all’incidenza delle misure adottate dagli Stati membri per reagire all’emergenza sanitaria sull’acquis dell’Unione, con particolare riguardo al sistema Schengen. Il contributo conclude che il diritto UE, anche alla luce del principio di leale cooperazione, ha portato all’emersione di obblighi di coordinamento che le istituzioni sovranazionali e gli Stati membri debbono implementare nel contrastare il virus.

This article aims at illustrating the reaction put in place at supranational level to the outbreak of Coronavirus. In particular, the analysis is focused on the implementation of the relevant European Disaster Law instruments, namely the Union Civil Protection Mechanism and the Decision No 1082/2013/EU on serious cross-border threats to health. Here their functioning and legal implementation are taken into consideration. On the other hand, the article considers the possible interference of the Member States’ reaction to the health emergency with the proper implementation of EU acquis, with particular regard to the Schengen cooperation. The article argues that in both cases EU law, also in the light of the principle of sincere cooperation, has led to the emergence of coordination duties that EU institutions and Member States should enforce in the fight against the virus.
