Gli aiuti di Stato nel settore bancario e l’affaire Tercas: quando finisce la discrezionalità e quando inizia la responsabilità

Il caso Tercas ha destato grande interesse nella comunità scientifica – e non solo – per gli effetti che la decisione del giudice dell’Unione è destinata a produrre oltre il caso di specie. La pronuncia della Corte, che ha confermato la sentenza resa in primo grado dal Tribunale, arriva sì all’esito di un contenzioso che ha visto opporsi la Commissione ed esponenti del sistema bancario italiano, ma interessa per la sua portata tutte le autorità pubbliche e gli istituti di credito degli Stati membri dell’Unione. Invero, l’interpretazione dell’art. 107 TFUE fornita nei due giudizi è in grado di influenzare notevolmente i futuri interventi della Commissione in materia di aiuti di Stato alle banche.

The Tercas case has aroused great interest in the academic community – and beyond – because of the effects that the CJEU’s judgment is bound to have beyond the present case. The Court’s ruling, which upheld the ECG judgment, comes at the end of a dispute between the Commission and representatives of the Italian banking system, but is of interest to all public authorities and credit institutions in the Member States of the European Union. Indeed, the interpretation of Article 107 TFEU provided in the two judgments is capable of significantly influencing the Commission’s future interventions in the field of State aid to banks.
