Uno, nessuno e centomila. I criteri di operatività del principio ne bis in idem

La lunga storia del principio di ne bis in idem è stata caratterizzata da profonde antinomie giurisprudenziali, che hanno visto a confronto la Corte EDU, la Corte di giustizia e, non di rado, le Corti nazionali. Il confronto ha riguardato principalmente entrambi gli elementi che compongono il principio in parola, ovvero il bis e l’idem. Di recente, la questione dei criteri che sovraintendono l’operatività del principio è tornata sotto i riflettori, grazie a due sentenze della Corte di giustizia, del 22 marzo scorso, ovvero i casi bpost (C-117/20) e Nordzucker e a. (C-151/20) che hanno ricondotto ad unicum quelli che la Corte aveva elaborato con riferimento alle diverse politiche. Le due pronunce lasciano, però irrisolte talune questioni e ne pongono delle nuove.

The long history of the ne bis in idem principle has been characterised by significant jurisprudential antinomies, which have involved the ECHR, the Court of Justice and, not infrequently, national courts. The comparison has mainly concerned both the elements that make up the principle in question, i.e. the bis and the idem. Recently, the question of the criteria that govern the operation of the principle has returned to the spotlight, thanks to two Court of Justice judgments of 22 March, namely the bpost (C-117/20) and Nordzucker and Others (C-151/20) cases, which brought back to a unicum those that the Court had developed with reference to different policies. The two judgments leave, however, certain questions unresolved and raise new ones.
