The notion of international public order and the worthy of approval recent decisions of the United Sections of the Italian Court of Cassation

Abstract:

Taking into consideration the subject of the first advisory opinion of ECtHR, the Author analyses the evolution of Italian concept of public policy according to the Supreme Court of Cassation case law, whose last decision concerns precisely the surrogate motherhood. The important judgment of the Italian Supreme Court of Cassation, United Sections, No.16601/2017 about punitive damages adopted a concept of international public policy (or order) advanced in comparison to the more traditional one but relatively large. The same concept has been then confirmed and at once specified by another important judgment of the Italian Supreme Court, United Sections, the No. 12193/2019 about surrogate motherhood. Although there is no lack in scholars and even judges of other opinions and tones, it seems therefore that the Italian law is going to preserve a concept of international public policy which contains a significant defensive potential of the most important national legal peculiarities. That seems in principle worthy of approval.

La sentenza delle Sezioni Unite della Cassazione del 2017 sul risarcimento punitivo si è caratterizzata per l’adozione di una nozione di ordine pubblico internazionale, sia pure evoluta rispetto a quella più tradizionale, relativamente ampia. La medesima nozione è stata poi confermata e al tempo stesso precisata dalla sentenza delle Sezioni Unite della Cassazione del 2019 sulla maternità surrogata. Nonostante che non manchino in dottrina e nella stessa giurisprudenza ricostruzioni e accenti differenti, sembra pertanto che il diritto vivente italiano sia destinato a conservare una nozione di ordine pubblico internazionale contenente una significativa potenzialità difensiva delle più importanti specificità normative nazionali, ciò che pare in linea di principio da approvare.
