Le pregiudiziali Randstad sull’incensurabilità per cassazione della violazione di norme europee imputabile al giudice amministrativo

Lo scritto affronta la questione della censurabilità in Cassazione della violazione di norme europee imputabile al Consiglio di Stato, concentrandosi sui quesiti pregiudiziali rivolti dalla Corte di Cassazione, nell’ordinanza n. 19598/2020, alla Corte di giustizia. Il compito affidato ai giudici di Lussemburgo è arduo, poiché dai quesiti emergono distonie tra organi apicali del potere giurisdizionale circa la configurabilità di eventuali limiti esterni all’esercizio della iurisdictio statale. Tali limiti sarebbero imposti, secondo la Cassazione, dal rispetto del diritto dell’Unione. La Corte costituzionale ha invece sostenuto una prospettiva opposta ai sensi della nostra Carta costituzionale. Senza alcuna pretesa di prevedere l’esito del giudizio, lo scritto analizza i principali filoni giurisprudenziali applicati della Corte di giustizia in casi simili.

This paper deals with the justiciability before the Italian Court of cassation of EU law violations attributable to the ‘Consiglio di Stato’, and focuses on the preliminary questions addressed by the Court of cassation to the CJEU (order no. 19598/2020). The task entrusted to the Luxembourg judges is arduous, for the referred issues reveal tensions between the Italian highest Courts regarding the admissibility of external limits to the judiciary power aimed at ensuring compliance with EU law. While the Court of cassation argues for the existence of such limits, the opposite view has been taken by the Italian Constitutional Court pursuant to the national Constitution. Clearly, the paper does not intend to predict the outcome of the proceedings before the CJEU. It rather analyses the main jurisprudential strands applied by the Court of Justice in similar cases.
