Identity Politics and Constitutional Disagreement: The Rise of the “New” Populisms and Nationalisms in the Fragmented European Landscape

Abstract: Negli ultimi anni, il fenomeno delle identity politics ha messo sotto tensione i sistemi costituzionali liberali costruiti per fornire una cornice istituzionale entro la quale il disaccordo politico tra i cittadini possa trovare una composizione pacifica. Sotto il profilo teorico, teorie costituzionali come quella del cosmopolitismo o del sovranazionalismo hanno mostrato più di una fragilità nella gestione dei conflitti che animano gli ordinamenti moderni, appesantite dalla costante richiesta di riconoscimento pubblico delle identità dei molteplici ed eterogenei gruppi sociali presenti nelle società pluraliste. Il fenomeno delle identity politics rappresenta quindi un motore della rinascita del concetto di identità nazionale che, a sua volta, alimenta l’affermazione e la diffusione di nuovi populismi e sovranismi. Il presente lavoro intende indagare lo scontro tra sovranazionalismo e politiche identitarie all’interno del sistema costituzionale europeo, analizzando dal punto di vista teorico e pratico le cause che hanno portato alla rinascita dei nazionalismi europei (con un focus sul caso ungherese), nel tentativo di trarre suggestioni su possibili strade da seguire per risolvere tale conflitto all’interno del sistema costituzionale europeo.

Abstract: The rise of identity politics is challenging the modern liberal democracies and the constitutional agreements that come from it. Constitutional theories such as cosmopolitanism or supranationalism are no longer capable of fixing the conflicts we are living within our pluralistic societies, since social groups feel their identities are not receiving adequate recognition in the public square. Whenever these requests for identity’s recognition cannot find places where make their voice heard, they may lead to new forms of populism/nationalism. The paper will address the clash between supranationalism and identity politics especially within the European multilevel constitutionalism, investigating the origins of the current European nationalisms and focusing on the Hungarian one. In the light of this analysis, the paper will try to answer the following questions: how can European constitutionalism fix this identarian clash? How can it manage the political and constitutional disagreement?
